These terms and conditions govern the Celebrity Eyes Prize Draw. References to “us”, “we”, “ours”, “Orbis Charitable Trust” or “Orbis UK” shall be to the Promoter (as detailed in condition 1 (The Promoter) below). References to “you” or “yours” shall be to you, the person who has entered, or is considering entering into, the Celebrity Eyes Prize Draw. Entry into the Prize Draw in accordance with condition 3 (How to Enter) below shall be legally binding on you and us.

THE PROMOTER

1. The Prize Draw is being promoted by Orbis Charitable Trust (also known as Orbis UK), registered charity number 1061352 of Sixth Floor, 10 Lower Thames Street, London, EC3R 6AF

2. By entering the Prize Draw you are agreeing to these Prize Draw terms and conditions.

ELIGIBILITY TO ENTER

3. Entrants must be aged 18 years or older and resident in the UK at the time of entry.

4. Employees of Orbis UK, their families, agents or anyone else connected with this promotion, are not eligible to enter.

5. By entering the Prize Draw, you confirm that you are eligible to do so and that you are eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the Prize Draw.

6. The Promoter reserves all rights to disqualify you if: (a) your conduct is contrary to the spirit or intention of the Prize Draw; and/or (b) if you breach these Prize Draw terms and conditions.

7. If you are a winner, Orbis UK may request that you participate in any publicity or promotion organised by Orbis UK, including promotional photographs.

HOW TO ENTER

8. Participants can enter the Prize Draw from midnight on the 1^st of each month until 11:59pm on the last day of each month, either online for paid entries or by post for free entries. Any postal entries into a given month’s prize draw that arrive at Orbis UK after the last day of that month will not be accepted.

10. Entrants choose which celebrity’s eyes they think the image depicts, from a list of multiple-choice answers.

11. Entrants are permitted to officially enter into more than one prize draw and enter each draw an unlimited number of times.

12. Entries can be received in two ways:

a. Paid method:

i. To be received from midnight on the 1^st of each month until 11:59pm on the last day of each month.

ii. Each entry amount will come with a set number of entries for the stated celebrity prize.

iii. Follow the instructions to enter your name, contact details and payment information, and complete your payment.

iv. You can enter as many times as you wish.

b. Alternative Method of Entry:

i. To be received from midnight on the 1^st of each month until 11:59pm on the last day of each month.

ii. On a blank sheet of paper or postcard, write the date, your full name, address (no post office box addresses accepted), city, post code, date of birth (dd/mm/yyyy), telephone number, email address and which celebrity you are guessing, which you can select from the list here: https://celebrityeyes.co.uk/

iii. Indicate which celebrity you are entering the Prize Draw for. Only one celebrity can be listed per entry.

iv. Post the completed entry to Orbis UK, Sixth Floor, 10 Lower Thames Street, London, EC3R 6AF

v. You may enter by the Alternative Method of Entry as many times as you wish per prize draw, but we can only accept one entry per blank sheet of paper or postcard. Each entry must be posted separately.

vi. Orbis UK is not responsible for lost, late, destroyed, delayed, inaccurate, incomplete, postage due, misdirected entries or entries not received by the last day of the entry period.

13. Multiple entrants may not share the same email address. In the event of a dispute as to the identity of an entrant, the authorised account holder of the email address used to enter will be deemed to be the entrant. The “authorised account holder” is the natural person assigned an email address by an internet access provider, online service provider or other organisation responsible for assigning email addresses for the domain associated with the submitted address.

14. Participants must provide all reasonably required information specified on the Prize Draw page and entry form, and in these terms and conditions, in order to be eligible to enter and win.

THE DRAW

15. The winners will be selected at random, by a random number generator, from all entries received by the closing date.

16. A winner will be randomly selected on the 1^st day of each month.

17. The winners will be notified within 10 days by phone and/or email.

18. The Promoter may perform background screening or security checks, at its discretion and in accordance with Orbis UK’s Privacy Policy: orbis.org.uk/privacy-policy

19. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted, is unavailable or has failed to claim the prize within 14 days of being notified of their win, then the winner’s prize will be forfeited and Promoter reserves the right to select another winner in accordance with the process described at condition 14 above. This process will be repeated until the prize is awarded.

20. The Promoter does not accept any responsibility if the winner is unable to take up the prize.

21. A winner may be ineligible to receive the prize if:

a. The background screening or security checks indicate potential harm to Orbis UK, the celebrity or the potential winner; or

b. The potential winner has failed to comply with these terms and conditions in any respect.

22. If a winner is disqualified for any reason set out in this condition 20, then the winner’s prize will be forfeited and Promoter reserves the right to select another winner in accordance with the process described at condition 14 above. This process will be repeated until the prize is awarded.

THE PRIZES

23. The prize is £500.00 cash.

24. To claim their prize, the winner will be asked to provide their sort code and account number to Orbis UK within 14 days of being notified of their win, so that the prize money can be transferred by BACS. The winner should expect to receive the prize money in their account no more than seven working days after they have supplied their details. Orbis UK will confirm when the prize money has been transferred and the winner’s bank details will not be kept on record after this date.

25. Orbis UK does not accept any costs incurred by the winner to redeem the prize.

26. Orbis UK does not accept any responsibility for transferring prize money to the wrong account if the winner provides incorrect bank details.

27. The prize money is not transferable to another individual, and is non-exchangeable.

28. Orbis UK does not accept any liability for any damage, loss, injury or disappointment suffered by any entrants as a result of either participating in the Prize Draw or being selected for a prize.

DATA PROTECTION AND PUBLICITY

29. The Promoter will only process your personal information as set out in Orbis UK’s privacy policy, which is available at: orbis.org.uk/privacy-policy

30. By entering this Prize Draw, you acknowledge that the Promoter will contact you if you are the prize winner, to confirm that you have won.

31. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of prize winners and, if applicable copies of their winning entries, to anyone who emails [email protected] or writes to Orbis UK, Sixth Floor, 10 Lower Thames Street, London, EC3R 6AF (enclosing a self-addressed envelope) within one month after the closing date stated in condition 8. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at [email protected]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

GENERAL

33. Orbis UK reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Prize Draw should a virus, bug, non-authorised human intervention, fraud, or other cause beyond Orbis UK’s control corrupt or affect the administration, security, fairness, or proper conduct of the Prize Draw. In such cases, Orbis UK may select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Orbis UK.

34. By entering, you agree to release and hold harmless Orbis UK and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:

a. such entrant’s participation in the Prize Draw and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof;

b. technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment;

c. the unavailability or inaccessibility of any transmissions, telephone, or Internet service;

d. unauthorised human intervention in any part of the entry process or the Prize Draw;

e. electronic or human error in the administration of the Prize Draw or the processing of entries.

35. This prize draw is in no way sponsored, endorsed or administered by, or associated with Facebook.

36. The Prize Draw will be governed by English law and entrants to the Prize Draw submit to the exclusive jurisdiction of the English courts.
